Cold Sweats? The Leave of Absence Nightmare—Understanding the FMLA and How it Leads to ADA Reasonable Accommodation Issues.

Jason E. Reisman | Obermayer Rebmann Maxwell & Hippel LLP

Even though both the Family and Medical Leave Act (FMLA) and the Americans with Disabilities Act (ADA) have been around for years, the issues surrounding them still confuse most employers (and even lawyers!).  With the recent changes in the law affecting both statutes and the potential for additional changes, compliance may become even more puzzling. This presentation provides guidance for the scenario where an extended leave of absence transitions from FMLA into ADA reasonable accommodation issues.  When an employee requests a leave of absence, employers must be very careful in handling all aspects of the leave request, as the entire voyage can be fraught with peril.
