With the massive shift toward medical cannabis throughout the United States, companies are being challenged to reinterpret their drug-related workplace policies.  As these states, including PA, also have antidiscrimination provisions, employers are now faced with a new protected class:  cannabis users.  Now, with the aftermath of the COVID pandemic, moreover, we will see more cannabis use than ever before.  This program will provide employers with blackline standards on what they can and cannot legally do, a robust toolbox of best practices to weed out the good from the bad.

    Learning Objectives:

Discussion of the federal and state statutes, including

    • The Controlled Substances Act
    • Americans with Disabilities Act
    • Family and Medical Leave Act
    • State medical cannabis laws (MMAs) overview
    • Pennsylvania’s MMA

Exploration of the cannabis caselaw, including implicit protected classes and drug free workplaces

Discussion about the differences between legal and illegal cannabis use in workplace policies and procedures

This program is valid for 1PDCs for the SHRM-CP® or SHRM-SCP®.
