    The focus of this presentation is on understanding the critical components of helping management teams avoid employment litigation that often results from poorly handled discipline and discharge situations.  No area of employee relations is more important or more difficult to administer effectively than employee discipline and discharge. Without a reliable process for dealing with disciplinary problems, an employer will be needlessly plagued by employee relations problems and litigation risks.

    Learning Objectives:

    • Participants will walk away armed with an understanding of the essential employee relations “rules” in the discipline and discharge process. That knowledge will enable them to confidently manage discipline and discharge in the workplace, while also coaching and counseling management in those situations.  
    • The presentation will heighten the participants’ sensitivity to, and awareness of, the topics discussed.  Not everyone recognizes the importance of the “process” in terms of legal risk minimization – and the critical role of HR in putting the company in the best position to defend its decisions, if required. 
    • The concepts conveyed will help attendees understand the “art” of documentation and some common pitfalls in the process of handling discipline and discharge situations.  The strategies conveyed will assist in fostering more positive employee relations, which leads to the reduction or even elimination of risk (e.g., lessening the chance of an employment discrimination charge or a lawsuit).
